It has come to the attention of the Missouri Office of Administration that some political subdivisions and other government entities are making use of a Division of Facilities Management, Design & Construction contract that “prequalified” various energy services companies for work in state facilities, to disqualify other energy services companies from competing for contracts. Some public entities have included language in contracts for energy services companies limiting bidding only to firms that meet the following minimum requirements: "State of Missouri Office of Administration Pre-qualified Energy Performance Contracting Firms Project No. 00410-02".
The contract let by the Division of Facilities Management, Design & Construction in 2005 was specific to work to be performed in state buildings and was an effort to streamline the state procurement process. It was never intended to be an exclusive list or limit competition for energy consulting projects by other political subdivisions or government entities in the State of Missouri.
