This is mid-level quasi-judicial work conducting hearings and writing decisions on unemployment insurance appeals, in all but the most involved and complex administrative determinations.

Minimum Qualifications

Applicants must meet one of the following eligibility requirements:

(The following minimum qualifications will determine merit system eligibility. Allowable experience and education substitutions are provided in italics below the corresponding minimum qualification statement; no other substitutions will be permitted. These minimum qualifications may also be used to evaluate applicants for Missouri Uniform Classification and Pay System positions not requiring selection from merit registers.)

One or more years of experience as an Appeals Referee I with the Missouri Division of Employment Security; and possession of a high school diploma or proof of high school equivalency.

OR

A Bachelor's degree from an accredited college or university with a minimum of 15 earned credit hours in one or a combination of the following: social sciences, Education, Law, or Public or Business Administration; and ,

Three or more years of professional experience for a state or federal unemployment insurance program in a supervisory, administrative, or managerial capacity, which included one or more years of quasi-judicial work in conducting hearings and writing decisions on appeals from administrative determinations regarding unemployment insurance benefit determinations.

OR

Graduation from a school of law accredited by the American Bar Association.

(Admission to the Bar in any state in the United States will be accepted in lieu of graduation from an accredited law school.)

Job Duties

This description may not include all of the duties, knowledge, skills, or abilities associated with this classification.

Conducts hearings informally with interested parties and their counsel: places witnesses under oath, questions witnesses to ascertain pertinent facts, directs the recording of testimony, admits or excludes evidence, and facilitates the cross-examination of witnesses.

Reviews, prior to hearing, pertinent material which has a bearing on scheduled appeals.

Evaluates all facts pertinent to a case and prepares a written finding of fact and decision, applying pertinent provisions of the law and following established precedents.

Studies precedent decisions in similar cases as a guide for making decisions.

Assists in the training of lower level Appeals Referees.

Exercises considerable judgment, discretion, and tact in the hearing of controversial matters, and in the preparation of findings and decisions which may be appealed to the Labor and Industrial Relations Commission and courts, and must be supported by legally competent evidence in the record of the hearing.

Works independently, but is subject to review for conformance with agency policy and precedent decisions by an Appeals Referee III or an administrative supervisor.

Performs other related work as assigned.

Key Skills

Comprehensive knowledge of the general provisions and philosophy of the Employment Security program and of state and federal laws and policies pertaining to unemployment insurance and related fields.

Comprehensive knowledge of the principles and practices to be followed in the conduct of quasi-judicial hearings.

Comprehensive knowledge of appeals rights, rules of evidence, and procedures as set forth in pertinent laws and administrative regulations pertaining to Employment Security.

Comprehensive knowledge of established precedents and policies regarding unemployment insurance and ability to apply them to appeals decisions.

Ability to evaluate, accurately and impartially, a variety of data and to prepare a sound and substantiated decision based on the evidence.

Ability to question witnesses effectively and to control proceedings in order to arrive at the essential facts of a case as expeditiously as practicable.

Ability to work effectively and tactfully with many different types of persons in complex and controversial situations.
